1. Agreement
These Terms of Service ("Terms") govern your use of the ParcelPoint website, applications, and shipping services (collectively, the "Services"). By creating an account, booking a shipment, or otherwise using the Services, you agree to be bound by these Terms.
2. Definitions
- "ParcelPoint", "we", "us", "our" — the entity operating the delivery network and platform.
- "You", "Shipper" — the individual or business that books a shipment or otherwise uses the Services.
- "Recipient" — the person or business to whom a Shipment is addressed.
- "Shipment" — any parcel, package, freight, or item tendered to ParcelPoint for delivery.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. You agree to provide accurate, complete, and current information when using the Services.
4. Booking a Shipment
When you book a Shipment, you confirm that:
- The contents are accurately and truthfully declared, including value, weight, and dimensions.
- The Shipment does not contain prohibited or restricted items (see Section 5).
- You have the legal right to ship the contents to the destination.
- Recipient contact information is correct and current.
We may refuse, hold, or return any Shipment that violates these Terms, applicable law, or carrier regulations.
5. Prohibited & Restricted Items
You may not ship items that are illegal in the origin or destination country, or that present a risk to people, animals, equipment, or other shipments. Prohibited items include, without limitation:
- Currency, negotiable instruments, and bullion;
- Firearms, ammunition, explosives, and weapons;
- Illegal drugs, controlled substances, and unregistered pharmaceuticals;
- Live animals and human remains (without prior written approval);
- Hazardous materials except via our Hazmat-approved service;
- Perishable goods except via our Cold Chain service;
- Counterfeit goods, items infringing intellectual property, and stolen property.
If a Shipment is found to contain prohibited items, ParcelPoint may surrender it to the relevant authorities and charge you any associated costs.
6. Pricing, Fees & Payment
Rates are presented at the time of booking and may include a base rate, a fuel surcharge, distance and weight components, customs handling, and optional insurance. Volumetric (dimensional) weight may be used where it exceeds actual weight. Payment is due at booking unless you have a business account with deferred billing. You authorize ParcelPoint to charge the payment method you provide for all amounts owed, including reweigh adjustments and customs duties paid on your behalf.
7. Delivery & Transit Times
Quoted transit times are estimates and not guarantees, except where a specific money-back guarantee is offered for a service tier and the failure was not caused by an event beyond our control. Delivery may be delayed by weather, customs, recipient unavailability, incorrect addresses, or other factors. We will use commercially reasonable efforts to keep you informed of the status of your Shipment through the tracking interface.
8. Recipient Acceptance
Delivery is complete when the Shipment is handed to the Recipient, left at the address per your instructions, photographed in a designated safe location, or signed for. If the Recipient refuses delivery or cannot be located after reasonable attempts, the Shipment will be held at a local facility or returned to you, and additional fees may apply.
9. Liability & Insurance
Standard liability coverage of up to USD 100 is included with every Shipment unless higher coverage is purchased at booking. Higher tiers up to USD 5,000 are available. Liability is limited to the lesser of the actual repair or replacement cost of the goods and the declared value. ParcelPoint is not liable for:
- Sentimental, consequential, indirect, or punitive damages;
- Loss or damage caused by inadequate packaging by the Shipper;
- Acts of God, war, civil unrest, strike, embargo, or other force majeure events;
- Items that fall within our prohibited or restricted list.
10. Claims
To submit a claim for loss, damage, or missing contents, contact our claims team at claims@parcelpoint.com within 21 days of the scheduled delivery date. Include the tracking number, photos of the parcel and contents, and proof of value. Claims submitted outside this window may be denied.
11. Customs, Duties & Taxes
The Shipper is responsible for ensuring that international Shipments comply with the laws of both origin and destination. Duties, taxes, and customs fees are the responsibility of the Recipient unless you elect "DDP" (Delivered Duty Paid) at booking. We may detain, return, or destroy Shipments held by customs that cannot be cleared.
12. Privacy
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
13. Account Suspension & Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms, suspected fraud, or non-payment. You may close your account at any time by contacting support.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via the Services or by email. Your continued use of the Services after the effective date of any change constitutes acceptance of the revised Terms.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except where prohibited by applicable consumer law.
